The Supreme Court today struck down New York state's draconian law on defending yourself by carrying a concealed weapon.
The justices are finally catching up with the people.
I will let the lefty Yahoo News describe today's decision, "The Supreme Court on Thursday eased restrictions on carrying firearms in public, continuing a trend by the court in recent years of weakening gun restrictions.
"The court’s conservative majority ruled 6-3 that New York could not prohibit gun owners from carrying their handgun outside their home based on the state’s determination that the citizen lacked sufficient cause to fear for their own safety.
"The case of New York State Rifle & Pistol Association v. Bruen was based in a lawsuit brought by two New York men who challenged a state law that requires them to have a proper cause, or special need, in order to carry a firearm outside their home. The ruling will have a ripple effect for other states with similar restrictions, such as California, Hawaii, Maryland, Massachusetts, Connecticut and New Jersey."
Justices aren't weakening gun restrictions. The people are.
In the past year, the number of constitutional carry states has reached 25.
If you need the state's permission, it isn't a right; it is a privilege.
But the Lord gave you the right to defend yourself -- against a thug and a thug government.
And so Justice Thomas wrote the majority opinion in a 6-3 decision. The three Democrat justices were the no votes.
Thomas wrote, "If the last decade of Second Amendment litigation has taught this Court anything, it is that federal courts tasked with making such difficult empirical judgments regarding firearm regulations under the banner of intermediate scrutiny often defer to the determinations of legislatures. But while that judicial deference to legislative interest balancing is understandable -- and, elsewhere, appropriate -- it is not deference that the Constitution demands here. The Second Amendment is the very product of an interest balancing by the people and it surely elevates above all other interests the right of law-abiding, responsible citizens to use arms for self-defense. It is this balance -- struck by the traditions of the American people -- that demands our unqualified deference."
Not only did Thomas uphold the Second Amendment in this case, but he explained the Roberts Court's philosophy, which is to allow the states to do as they please as long as they do not tread on the rights of individuals.
However, the court is following the public on concealed carry. Texas which once banned concealed carry now has constitutional carry. By and large, states that have flipped Republican are leading the way on this matter.
It is the Vermontization of America. The Green Mountain Boys always put the right to firearms off limits to regulation. Interesting state. For 14 years, it was a republic -- longer than Texas and other states that were republics for a time.
The battle for the Second Amendment continues. From Massachusetts to Hawaii, there are clusters of holdouts who allow sheriffs to decide who shall have the right to defend himself.
Today, the Supreme Court recognized this peaceful revolution for the right to keep and bear firearms.
I hope justices are prepared to strike down any gun restrictions Congress issues this year because the Second Amendment protects all our other God-given rights.
Imagine where this court would be if the NeverTrumpers had been successful. The 2nd Amendment would be ancient history. Thank God for Trump and Clarence Thomas.

This session of the court is getting things right. Now we need to walk back the draconian unconstitutional rules imposed by the ATF.

DeleteI am out of my depth on your gun rights, but based on everything that I have read today the decision makes total sense and is a bit late in coming after Heller. You have a free country when you can defend yourself. You don't want to be waiting for the police to rescue you or your kids, witness Uvalde. You don't want to live in a place where only the criminals and police can carry. Our prime minister has told us that guns are for hunting or target shooting. Bravo for freedom.
ReplyDeleteLuAnn, there's a old and very true saying in the U.S.: When seconds count the police are minutes away. Never depend on someone else to defend you and yours. It generally doesn't end well. If the Patriots at Lexington and Concord had knuckled under to the British in April 1775 and allowed them to take their arms (which was the British plan), the U.S. never would have become the great country that it became. Thank God for the Founding Fathers and all who follow in their footsteps.

My understanding is the 2nd Amendment was written with the black population in mind at the time.

This was a good and proper decision by the Court, but in no way is this a victory. The state law that was struck down was written in 1913. This decision would have been a victory back in 1914-15. Taking over 100 years to get our rights back is NOT a victory. It's the end of an injustice and we should be pissed that it took so long.
ReplyDeleteEvery woman who was denied a permit in New York and later attacked or raped should sue the State of New York for damages.
Many people died in that state over the past century because of having their rights denied. We should be pissed.
