Why isn't Michael Byrd on trial?

I ask an uncomfortable question. Why isn't Michael Byrd on trial? He shot and killed Ashli Babbitt during a mostly peaceful protest inside the Capitol on January 6.

Three trials this year beg this question.

The most recent trial ended last week when a jury convicted Kim Potter, who while a police officer shot and killed a driver who was trying to leave the scene after he was pulled over by the cops. Potter said she mistook her gun for a taser. While that may be true, nevertheless the jury found her guilty of first-degree and second-degree manslaughter.

The first of the three trials was of Derek Chauvin who was convicted of killing George Floyd. A drug user with a record of crimes, Floyd was higher than a kite. Chauvin, then a police officer, held him down awaiting putting him in jail. He blocked medical treatment. Floyd died later in custody. A jury convicted Chauvin of murder.

The third was the trial of Kyle Rittenhouse who shot and killed two rioters who attacked him, and wounded a rioter who pulled a gun on him. The jury found him innocent of all charges. 

As a casual observer, I think jurors got all three verdicts right.

Which brings me to Byrd. Why should he not face a jury of his peers to determine whether his killing of Babbitt was murder?

NBC reported in August, "In the chaotic minutes before he shot and killed Ashli Babbitt during the Capitol riot on Jan. 6, Lt. Michael Byrd focused his attention on the glass doors leading into the lobby of the House of Representatives chamber.

"About 60 to 80 House members and staffers were holed up inside, and it was Byrd’s job to protect them.

"As rioters rampaged through the Capitol, Byrd and a few other officers of the U.S. Capitol Police set up a wall of furniture outside the doors.

"'Once we barricaded the doors, we were essentially trapped where we were,' Byrd said in an exclusive interview with NBC News’ Lester Holt, speaking publicly for the first time since the riot. 'There was no way to retreat. No other way to get out.

"'If they get through that door, they’re into the House chamber and upon the members of Congress,' added Byrd, who gave NBC News permission to use his name after authorities had declined to release it."

He told a harrowing tale. As did Potter. As did Rittenhouse.

But there also is video, the same thing that brought Chauvin and Potter down, but video exonerated Rittenhouse. Let's go to the tape. Let's let a jury decide whether shooting an unarmed woman who seemed to pose no physical threat to anyone was a justifiable homicide.

We all know why Byrd won't stand trial. It's the same reason Hillary didn't and Hunter won't. They are part of the protected class. They are above the law. A Washington that blew millions on an investigation into a conspiracy theory about Russia that everyone knew was a lie won't spend 10 cents on real justice in these three cases.

I am not saying convict Byrd. I am saying try him, if only for the peace of mind of a nation that no longer can trust its federal government.

  1. Then there's Alec Baldwin who literally killed one person, seriously wounded another, and is free to give interviews about how misunderstood he is. Has he even been charged with anything? If you or I did this we'd be rotting in the tombs for a year.

    2. I think Don could write a similar article in regards to Baldwin's case. Jussie Smollett's celebrity, ultimately, didn't prevent him from facing trial and being found guilty. That ought not be because Jussie is black. Kim Potter's history as a police officer didn't prevent her from facing trial and being found guilty for accidentally killing a person with a gun. That ought not be because Kim is a woman. What's the reason for Alec Baldwin not being charged for negligent homicide? And also Michael Byrd?

    4. “Jussie Smollett's celebrity, ultimately, didn't prevent him from facing trial and being found guilty.” You’re forgetting the third part of the justice process: prison. Facing trial and being found guilty won’t mean squat if he’s sentenced to “community service.”

  2. In "Capitol Punishment," we see that Byrd shoots Babbitt with no warning and runs away.

    Babbitt's family deserves $27 million--the same amount that St. George of Fentanyl's family received.

    1. At this point, does it really matter that Michael Byrd was not charged for murder/manslaughter?
      The crime occurred inside the DC Beltway, where any trial would also have to be conducted. There is 99.999% chance that the DC jury would find Byrd innocent on all counts, just as OJ Simpson was found innocent of murdering Nicole.
      A trial would only rub our faces in the hypocritical inequity.

  5. I was down in DC on 1/6. OK, I wasn’t THERE there. I drove the entire Beltway circle looking for the caravan that never materialized. (Boo, Sundance) If it had, could I still be in a Swamp jail today? I dunno. But IT’S WELL PAST TIME TO LET THOSE PEOPLE GO. What would Desmond Tutu say about this?

    3. Yes. It seems every keeper of the law is 100% corrupted and now a member in good standing of the DC cartel. The only people willing to uphold the law, as written, are honest judges, and they're few and far between. The only solution is a Trump-style, fire-hose house cleaning from the top down.

  6. Byrd should be in custody awaiting trial and should be in the same prison as all others being held for January 6th indiscretions. I suspect that wouldn’t go well for him…

    2. Potter was over-charged. There was no intent, therefore the charge should have been 'involuntary manslaughter.' As it is, she's convicted of a crime she did not commit.

      Chauvin died as a result of Fentanyl poisoning, not a neck-hold. The cop was guilty of being a jackass which is not a felony--but in his case, it's damned close.

  9. Nobody killed Floyd but Floyd.

    Chauvin should have walked.

    As for Byrd (David Bailey is the real murderer), a trial would mean discovery and discovery would mean the country finding out Rosanne Boyland, Benjamin Phillips, and quite probably Kevin Greeson were murdered and Victoria White was beaten within and inch of her life while doing nothing to deserve it by the Capitol cops.

  10. Do not recall hearing testimony that Chauvin blocked medical treatment. The ambulance crew were afraid to arrive. When they did, they loaded him up and then left the unsafe area in order to provide treatment. Holding a person down does not constitute murder. Potter is also not guilty due to her use of force against a fleeing felon, which is justifiable. The use of Tazer or gun makes no difference in the laws' eyes, both are a use of force.
    Both of these verdicts, Chauvin and Potter, were from a scared people running scared from the BLM. It was not from a position of legality or justice.

    2. I used to trust jury trials. But that was when people had morals and they wanted to do good and follow the law. Now, most who get jury duty are immoral\woke\karens who rule based on feelings and fear. And then you have the DAs who are sold out to marxism and lie, cheat, and corrupt-and are corrupt- the institute of justice that they are supposed to represent.
      Way back when, the DAs were there for justice, and the Defense Attorneys were seen as slimy, do anything for money types to try and get the criminals out of their due charges.
      But seems, that has been turned 180.
      I no longer trust the courts - ESPECIALLY THE JUDGES - to do what is right according to the law.

  11. Chauvin and Potter were railroaded. They might have deserved a trial to assure the public but their was no justice done. Every aspect of society conspired to railroad Rittenhouse, Prosecution incompetence and misconduct were so blantant that the judge and jury could not be intimidated. Byrd won't be tried because he knows too much about what the Capitol Police were up to on January 6, 2021. A case could be made for trying Pelosi, the FBI, the DOD and the DOJ who orchestrated a tour that was more like a stroll than a rampage. 14,000 hours of video worth.

  16. The America hating liberals think of this murdering coward as a hero for shooting Ashli for standing up to obvious cheating and treason by the Dominionrat party during the 2020 election. Just like Lon Horiuchi, who murdered Vicki Weaver with a .308 NATO round to the face through her screen door, while holding a baby. Nothing ever happened to that murderer either. At this point, justice for these cowards will have to come from patriotic Americans.

  17. I think it's more basal than anything suggested here.

    Byrd is black. Babbit was white.

    In every other situation the police were white and the """victims""" were black.

    Rittenhouse is different, but the media tried to paint it the same way, white-on-black. Did any of you notice jump-kick-man was black, has been identified, and nothing has come of his revealed identity?

    I imagine Rittenhouse would have been found guilty if Mr.Jump-Kick Man had caught one of those rounds that night.

    They want you to see the colors. They want us hating each other because of our skin, instead of uniting against THEM because of their crimes.

We now actively hate it and fear it and realize that it is being run by the criminally insane who could at any moment decide to unleash the military upon those who it hates and wants to see dead. There's really not much holding them back from doing it. And a man cannot long live in that state of hate and fear without doing something to releave the pressure.

    On top of that hell scape, Half of the right and half of the left want the other side "to just die" according to polls, and I think they're accurate, for once, on that score.

    The only way this ship get's righted is after the SHTF.
    And it will, just a matter of a little more time.
