Ruth Bader Ginsburg died today of cancer at 87. Kane at Citizen Free Press reported RINO Senator Lisa Murkowski of Alaska will join Democrats in blocking President Donald John Trump from replacing her.Pres Trump just now on Justice Ginsburg: "Whether you agree or not ... she led an amazing life."
— Andrew Malcolm (@AHMalcolm) September 19, 2020
Murkowski said today before the death, "I would not vote to confirm a Supreme Court nominee. We are 50 some days away from an election."
I have no favorite for the replacement of Ginsburg, preferring to leave that to the president who delegated that to the Heritage Foundation, which has the time, energy, and motivation to screen lawyers to be judges and judges to be justices.
Sure, Ted Cruz would be a nice replacement but I believe there may be someone better whom I have never heard of.
Murkowski is punishing her party for nominating President Trump -- and she hates that her daddy was dethroned by the likes of Sarah Palin.
For decades, Republican presidents were stuck with appointing moderate judges and justices because Democrat Senates played hardball.
Now the Republican team controls the Senate, and Murkowski has flipped sides. Hers is a cynical position aimed at being in the good graces of a future Democrat Senate and White House. She has no principles. Her dad was a crook and she is a schnook.
How can you be a conservative and allow Democrats to get this appointment?
As for Justice Ginsburg, I refuse to speak ill of the dead. They are dead and unable to defend themselves.
Chief Justice John Roberts said, "Our Nation has lost a jurist of historic stature. We at the Supreme Court have lost a cherished colleague. Today we mourn, but with confidence that future generations will remember Ruth Bader Ginsburg as we knew her — a tireless and resolute champion of justice."
Fine.
The problem with the court is twofold: 1. these are lifetime appointments, and 2. the court is too powerful. All of the federal government is too powerful and two branches -- Congress and the courts -- have devolved into lifetime appointments. McConnell is seeking his seventh term.
I trust President Trump will nominate a replacement and the Senate will confirm 50-50 with Vice President Mike Pence casting the tie-breaking vote. That is what how our Constitution works.
My belief is this will rally voters behind him by being another Alpha Move. Biden is beta. Donald Trump should exploit that weakness.
It may well motivate conservatives to keep the Senate Republican too.
ReplyDeleteI agree that no Constitutional law classes will ever be quoting Ginsburg decisions in the coming years.
I took that part out because it is too early, but yes, you are right. She was not as a justice on the level of John Marshall Harlan.
Delete--- In a century, when the idea of depriving Americans in vitro of their civil rights to life will be seen as barbaric, Ginsburg will be cast to History's dustbin, as the Supreme Court upholding slave laws before the U.S. Civil War. ZB
DeleteBiden beta?
ReplyDeleteAldous Huxley would’ve said an Epsilon-Minus Semi-Moron.
I hate that she passed away in harness, this close to the century's defining election. She should have retired last year when she announced that the cancer had returned.
ReplyDeleteLike our host, I cannot celebrate her death. Any death is tragic, and the timing of this one raises even more peril for the Republic. This will galvanize the enemy to even greater agitation.
The death of evil is never "tragic".
DeleteIt's a blessing.
Murkowski is punishing her party for what?
ReplyDeleteOops. I had a Biden moment.
DeleteMurkowski is punishing her party for nominating President Trump -- and she hates that her daddy was dethroned by the likes of Sarah Palin.
Rains coming. Finally. I remember at the inauguration when it was raining Franklin Graham said it was a sign of Biblical blessings.I believe that.
ReplyDeleteHang in there. Ruth Ginsburg has to stand before throne. and account. I mourn for all the possibilities that were lost because of Roe V. Wade.
I am sorry she died. It is now up to God...
Profound…
Delete" It is now up to God..."
DeleteAs it has been since before the foundations of the earth were established.
If you make a deal with the devil for power, you have to expect failures at the most ironic or inopportune time. **Cough joe's eye pops a capillary on camera coughcough**
ReplyDeleteI had forgotten about that :)
DeleteEditorial writer John Fund is calling for the Senate to confirm a Justice.
ReplyDeleteBecause if the upcoming election leads to a massive "Bush v Gore" style lawsuit, we need to have an odd number of judges.
Someone over at Ace's place pointed out that a legal challenge to November's election is likely. What if that challenge reaches SCOTUS with a 4-4 ideological tie
ReplyDeleteAs I understand in the event of a SCOTUS tie, the lower court’s ruling stands. Perhaps someone here has a more informed answer.
DeleteThat is correct. Where it would really cause problems would be a scenario where multiple districts come to opposing rulings on similar cases regarding the election and the SCOTUS dreadlocks.
DeleteDreadlocks? Makes an amusing visual.
DeleteI would rather see an all out brawl to fill her seat before the election then trust that we can get a conservative in after the election (no matter how optimistic I am).
ReplyDeleteMurkowski and Romney will be speed bumps along the way, but they will not prevail.
"the winner if National Review's John McCain Award"
ReplyDeleteOf Don, not if.
Thanks
DeleteI'll fix it
Citizen Fee press AND FOX BRIT HUME SAY COLLINS WON"T SUPPORT A NEW nominee either before election.Trump will do it later in first term of 4 more years.
ReplyDeleteIMHO ......The Turtle should declare the Senate out of session on Nov 3 and Trump should make a Recess Appointment on Nov 4 to make sure the Court can make a well thought out decision if the election is riggged because of Mail in Voting.
ReplyDeleteIn a ruling by the SC, the Senate has to be out for 3 full days for recess appointments.
DeleteDidn't the dems pull a stunt like that during one Christmas recess? Like opened/closed session everyday for weeks so Obama could pull a expensive stupidass trick?
DeleteNever trust the democrats or the rinos. GO for it!
ReplyDeleteMs. Ginsburg' entry through the Pearly Gates will be delayed, as she is last in line behind all the millions of aborted souls she presided over, in her lifetime of legal opinions. ZB
ReplyDeleteI blame Marburg vs Madison. This decision took justices and made them oracles. The executive needs to put the justices back to their rightful constitutional place. This country is ready to go to war with itself over an appointment of a single person. It’s not worth it.
ReplyDeleteMeant to be Marbury. F..in auto correct.
ReplyDeleteTo the surprise of absolutely no one.
ReplyDeleteI believe the replacement will be Barrett. A good Catholic (as opposed to cafeteria types like Gropin' Joe), so bye-byes to Roe and maybe Lawrence.
The President should nominate a woman. When the left goes scorched earth to destroy her, and they will, we destroy Sen. Harris with the same tactics.
