Reining in the 9th Circus Court

If anyone wonders why we call the Ninth Circuit Court of Appeals the 9th Circus, show them this paragraph from the Washington Examiner:
The 5-4 decision reversed the 9th Circuit Court of Appeals, which said officials have to detain these immigrants immediately or they are exempt from ever being detained.
Justices said "that's all folks" to that Looney Tune decision.

The issue was whether immigrants who rape, murder, or commit some other heinous crime can be deported afterward. Federal law holds that there is mandatory detention for them to decide whether they should be sent back to where they came from.

The 9th Circus ruled that the federal government must do so immediately or else forfeit the ability to deport a criminal.

Given that California does not notify the federal government if the immigration status of criminals, this is a problem.

While the four Clinton and Obama appointees to the court ignored the law, the five Republican judges upheld the law. Justice Samuel Alito wrote the majority opinion .

The Washington Examiner reported, "Alito wrote that in the past, the court has 'held time and time again, an official's crucial duties are better carried out late than never.'

"He also rejected the argument from lawyers representing the immigrants involved in the case that they are subject to mandatory detention only if they are arrested 'on the day he walks out of jail,' giving the example that state and local officials 'sometimes rebuff the government's request that they give notice when a criminal alien will be released.'"

While the Fake News made this out as a Trump administration case, the case began on Barack Hussein Obama's watch. His administration wanted to deport the criminals.

It is rather cute to see Breyer and the Three Stoogettes rule that Obama violated the Constitution.

Sadly it comes in one of the cases where he did the right thing.

    Sad that as usual, the opinions of four “justices” are known even before a case is argued before the court.

  3. Anti-American Democrats (but I repeat myself) can count on their politicians and judges to remain on the reservation 100% of the time. Sadly, Republicans never know when their politicians and judges will suddenly pull pretzel logic out of their bag of tricks, "reach across the aisle" and flip on a critical issue.

    Trump and a few of his fellow travelers are the only ones in power Republicans can rely on to remain pro-American. It's a short list.

  4. Its terrifying that four Justices are so lacking in self-respect and self-awareness that they would dissent from an opinion this basic. The mask has come off and these four Justices have just admitted that they are political hacks put in office to push a political agenda, not interpret the law.

    1. Agree. Masks are coming off all over the place. Such a big housecleaning is needed. At least it is now underway. But we've got to address the indoctrination going on in the colleges, as they are just an assembly line pushing out anti-American Marxists. And we got to be super-active in preventing 2020 voter fraud. The Dems are getting super-aggressive with threats to pack the Supreme Court, keep Trump off the ballot unless he discloses tax returns, overturn the electoral college, zero validation voter registration, ballot harvesting. This is a war. Shame on Republican officeholders who are naive about this (Romney, I'm talking about you, and both of our WV Senators). Starting to get pretty angry that they are missing from combat.

    3. I would have thought Romney had more integrity than that. And he's rich enough already, no need for him to sell himself. For the sake of his soul, he needs to step back and do some deep soul-searching about whether he is sincerely trying to help America and keep us free, or if he really wants to be a stooge of the Communist / Socialist destructiveness.

    4. For some of these dim-witted, round-heel Republicans, being a press darling (like McCain) and remaining on the DC cocktail party circuit is all they're seeking. Being pro-America is just some strange and silly notion to these destructive bastards. Big-money donors must laugh themselves to sleep every night over how little it costs to bribe these slime balls.

    Instead of a good, it would be a terrible decision.
