Judge tosses NYC's global warming lawsuit

New York City Mayor Bill de Blasio thought he could pick up a few billion bucks for the City Whose Tax Collectors Never Sleep by filing a nuisance lawsuit over global warming against five oil companies.

U.S. District Judge John Keenan stopped this nonsense today.

"Climate change is a fact of life, as is not contested by Defendants. But the serious problems caused thereby are not for the judiciary to ameliorate. Global warming and solutions thereto must be addressed by the two other branches of government," the judge said in tossing the lawsuit out.

The judge also said, "The immense and complicated problem of global warming requires a comprehensive solution that weighs the global benefits of fossil fuel use with the gravity of the impending harms."

The Reagan-appointed judge (elections matter, kiddies) became the second judge in three weeks to reject such a lawsuit out of hand.

Last month, Clinton-appointed Judge William Alsup threw out the claim by San Francisco and Oakland that Big Oil is making it too warm.

"The problem deserves a solution on a more vast scale than can be supplied by a district judge or jury in a public nuisance case," Judge Alsup wrote.

All three cities plan to appeal as the government has nearly unlimited resources in using the courts to wage a war against unpopular companies.

But by rejecting these lawsuits out of hand, Judges Alsup and Keenan made it easier for the appellate courts to just say no.

  2. I think the attorneys thought (and probably still do think) of this as just a coda to the successful class action and government tobacco litigation that made so many lawyers rich beyond their dreams.

  4. "the government has nearly unlmited resources..." sigh. Hell no it does not have nearly unlimited resources and this kind of lala land stupidity has the fed and most state govts in debt and short of resources to do things like fix bridges. Good lord our medua gets dumber ever passing year

  7. Elections dont matter, actually, as Judge Alsup's ruling (he was a Clinton appointee) tossed a nearly identical lawsuit out on its ear.

  8. Do your share first, NYC!

    Shut down every gas station in the five boroughs and ban oil deliveries in the winter.

    And of course, ban all gas-powered vehicles from entering the city, including tractor trailers, buses, and delivery trucks.

    And don't even THINK about plowing snow and sanding roads with those giant diesel-guzzling dump trucks.

    Put your money where your mouth is, you freakin' greedy, virtue-signaling hypocrites.
