Enviros cannot stop the wall

The alien illegalus is about to become an endangered species in the southwest, and a federal judge is OK with that.


U.S. District Judge Gonzalo Curiel upheld the 2006 law that authorized building a barrier between Mexico and the United States.

An Obama appointee, Curiel was the target of an attack by Trump during the 206 presidential race. Curiel presided over the Trump University case, which Trump quietly (well, by his standards) settled shortly after winning the election. Pretty much the plaintiffs had him dead to rights.

"In his 101-page ruling, the judge said his decision 'cannot and does not consider whether the underlying decisions to construct the border barriers are politically wise or prudent.' He also referred to his Indiana roots with a quote from Chief Justice John Roberts," NPR reported.

That reference in the ruling was, "As fellow Indiana native Chief Justice Roberts observed in addressing a case surrounded by political disagreement: 'Court[s] are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments. Those decisions are entrusted to our Nation's elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices.'"

Hahaha.

I love it.

Elections have consequences.

Expect the case to be appealed because environmentalism is a lucrative business. But Curiel pretty much killed it by citing Justice Roberts. Do you really think a Supreme Court that upheld Obamacare is going to stop a wall?

But we shall see, shan't we?

  2. I have a healthy loathing of that judicial quote and that judicial philosophy. I see it brought forth when politicians are acting unconstitutionally. I see it when courts are refusing to serve in the role of check and balance. It's an abdication of responsibility.
    Stupid voters. They got the government they deserve.
    Well, the stupid voters may be getting what they deserve, but the individual looking to the courts and the constitution for protection from the tyranny of the majority is out of luck.

    1. Nothing more than a clear reading of the law is or was necessary. Previously enacted law allows for the building of a national border to be exempted from environmental regulations up to and including the endangered species act.

    3. I'm quite happy to have judges state that policy is out of their jurisdiction. I think we've had enough of Hawaiian judges setting immigration policy for the country.

      Because those who wrote the laws Pres. Trump upholds were not Marxist, socialist liberals, judges who agree with him are also not [acting like] Marxist, socialist liberals. Those who disagree, who take the opposite position, then, are.
