The Justice Kennedy quote is merely a broad generalization with which most people could agree, but is not a statement about specific legal rights, in particular those that might be extended to animals sometime in the indefinite future. As for the SSM opinion authored by Kennedy, I can't think of any better example of why the 14th Amendment should be repealed, having long ago served and now outlived its original purpose with the passing of slavery and its immediate, direct after effects. The 14th A. is the source of much SCOTUS legal mischief, in the hands of someone like Kennedy being an open-ended invitation to legislate from the bench.
